The license granted to you is limited to a non-transferable license to use the Apps on any Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
App Skies is solely responsible for providing any maintenance and support services with respect to the Apps. Apple has no obligation whatsoever to furnish any maintenance and support services.
Some features of our Apps may require you to create an account. When creating an account, you agree to:
You are responsible for safeguarding your account credentials. We are not liable for any loss or damage arising from your failure to maintain the security of your account. You agree not to share your account credentials with any third party.
We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to violation of these Terms. You may also delete your account at any time through the App settings or by contacting us.

All purchases are processed through the Apple App Store. Refund requests must be submitted directly to Apple according to their refund policies. App Skies does not have direct access to process refunds. To request a refund:
You agree to use our Services only for lawful purposes and in accordance with these Terms. You are responsible for ensuring that your use of the Services complies with all applicable laws and regulations.

Our Apps may allow you to create, upload, or share content ("User Content"). You retain ownership of your User Content, but by submitting it, you grant App Skies a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in connection with our Services.
You are solely responsible for your User Content. You represent and warrant that:
We reserve the right, but have no obligation, to monitor, review, and remove User Content at our sole discretion. We may remove content that violates these Terms or that we find objectionable for any reason.
The Apps and all content, features, and functionality (including but not limited to text, graphics, logos, icons, images, audio, video, software, and the design, selection, and arrangement thereof) are owned by App Skies, its licensors, or other providers and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.
"App Skies" and our logos are trademarks of App Skies. You may not use our trademarks without our prior written consent. All other trademarks appearing in our Apps are the property of their respective owners.

Before initiating any formal dispute resolution proceedings, you agree to first contact us at appskiesltd@gmail.com to attempt to resolve the dispute informally. We will endeavor to resolve disputes within thirty (30) days of receiving your notice.
If we cannot resolve a dispute informally, you and App Skies agree to resolve any claims relating to these Terms or the Services through final and binding arbitration, except as set forth below. The arbitration will be conducted in accordance with the rules of a mutually agreed-upon arbitration organization.
The following disputes are not subject to arbitration:
YOU AND APP SKIES AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law principles. For disputes not subject to arbitration, you consent to the exclusive jurisdiction of the courts located in Istanbul, Turkey.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term. Our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction. Any attempted assignment in violation of this section shall be void.
We shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

Except as expressly provided herein (including with respect to Apple as a third-party beneficiary), these Terms do not create any third-party beneficiary rights.
